PART 1 - Terms & Conditions for Visa® Buxx™ Debit Card
This Agreement contains the terms that apply to your Visa Buxx Debit "Card". Read this Agreement thoroughly before you sign or use your Card and keep it for future reference. By signing, using or accepting your Visa Buxx Stored Value Card or by allowing a Teen child or other person to use the Card, you agree to be bound by the terms and conditions contained in this Agreement which will govern the use of the Card. In this Agreement, the "Card" means Visa Buxx Debit Card(s) issued by INOVA Federal Credit Union or distributed through Innovative Card Services, LLC, which maintains your Visa Buxx account. "Parent" means either the parent or legal guardian of the Teen. "Teen" means a child of the Parent who is at least 13 years of age, who is authorized by the Parent to use the Card. By authorizing the Teen to use the Card, the Parent represents that such Teen is at least 13 years of age. Any use of the Card by anyone under 13 years of age is an unauthorized use of the Card. You, not INOVA or Innovative Card Services, LLC, have sole responsibility in such cases. The words "you", "your" and "yours" in this Agreement mean the Parent, Teen, or anyone authorized to use or accept a Visa Buxx Debit Card. "Gift Giver" means a person that the Parent authorizes to fund the Card. The words "we", "us", and "our" mean INOVA or Innovative Card Services, LLC.
Important Information About Opening Your New Account
To help fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account.
I. Card Description
A. The Card is a proprietary form of a Visa Debit Card. The Card accesses a special account you have opened on behalf of the Teen, who is authorized to use the Card to access the funds in such account. The Card is not directly linked to any other checking or credit card account. The Card is not a credit card. No interest will be paid on the balances transferred to the Card account and such balances are not deposits and are not NCUA or FDIC insured. In conjunction with the Card and the rules associated therewith, you and the Teen must be residents of the United States to be eligible to have a Card issued and monies funded into the account accessed by the Card. As part of the account set up process, you will establish a designated funding account (the "Funding Account") from which funds will be transferred as authorized to the Card. The Funding Account must be either an Issuer debit or credit card. You may change the Funding Account from time to time and may have up to two (2) Funding Accounts at any given time. You will notify us of the name, age, relationship and address of the Teen you authorize to use the Card. Each Teen must have a separate Card account established. Each Parent may have a maximum of five Card accounts.
II. Using Your Card
A. You and the Teen are able to use your Card to:
1. Pay for purchases of goods or services at merchants who accept Visa debit cards, and have agreed to accept the Card ("point-of-sale transactions").
2. Obtain cash at Financial Institutions that accept Visa debit cards ("cash advance").
3. Perform transactions listed below on automated teller machines (ATM) that display Visa logos.
4. Access our on-line services to obtain Card account balances and review recent Card account history at www.InnovativeCardServices.com click on Visa Buxx login.
5. Access our telephone customer services number listed below.
B. Neither you nor the Teen may transfer the cash balance available on the Card to another credit union, bank, debit or credit card product.
C. Use of Card, the PIN and Terminal - The cardholder may be provided with a Personal Identification Number (PIN), which will allow them to use the Card at an ATM. The Teen can activate the Card and obtain a PIN by calling us at 866-763-3372
The Card and PIN are provided for your and the Teen’s use and protection, and you and the Teen agree:
1. to not disclose the PIN nor record it on the Card or otherwise make it available to anyone else;
2. to use the Card, the PIN and any ATM or point of sale terminal as instructed;
3. to promptly notify us of any loss or theft of your Card or PIN; and
4. to be liable for any transactions made by a person you authorize or permit to use your Card and/or PIN or any person who uses the card and/or PIN, even if not authorized. If you permit, or through circumstances allow, someone else to use your Card, we will treat this as if you have authorized this person to use your Card and you will be responsible for any transactions initiated by such person with your Card.
5. to not use the Card to engage in activities deemed illegal by federal and/or state laws, including but not limited to internet gambling. If you or the Teen uses the Card to engage in certain activities deemed illegal by federal and/or state laws, you and the Teen understand that you will nevertheless be liable for any authorized transactions made by the use of the Card.
D. You or an approved designated Gift Giver may load value onto the Card at any time using a Funding Account. Upon authorization, this will cause monies to be funded into the account accessed by the Card and be available for use by the Teen to make designated transactions. Approved transfers from a Funding Account will become available for use by the Card on the business day such transfer was made.
E. The maximum Card value is $2,000.00. If the Card has $2,000.00 available for purchases or cash withdrawals, additional amounts may not be loaded onto the Card. The maximum amount that can be transferred to the Card at any one time is $500.00.
F. The initial Card load minimum is $10.00. Thereafter, the minimum value that may be loaded onto the Card is also $10.00.
G. The maximum amount allowable for cash withdrawals from ATMs and cash advances from Financial Institutions that accept Visa debit cards is limited to $500.00 per day up to $3,000.00 per seven day period. You may elect to not allow cash withdrawals on your Teen's Card and you may designate a withdrawal limit less than the maximum allowed.
H. When you use the Card to obtain goods or services or to obtain cash, the merchant may attempt to obtain preauthorization from the Card account for the transaction. At least a three (3) day hold may be placed on the Card account for the amount of the preauthorization request. If the preauthorization request amount varies from the actual transaction posting amount, the preauthorization hold amount may remain on the account until the three (3) days expires. As a result, subsequent preauthorization requests against the hold amount may cause the transaction to be declined.
III. Payment
A. Each time you or the Teen uses the Card; the amount of the transaction will be debited from the account associated with the Card. Neither you nor the Teen is allowed to exceed the funded balance available on the Card by any individual or series of purchases. Nevertheless, if either you or the Teen makes a purchase which exceeds the balance on the Card (an "overdraft"), you shall remain fully responsible for either the amount of the purchases approved or the cash withdrawn, plus any service charges, which exceeded the balance available on the Card. We also reserve the right to automatically debit such overdrafts from current or future transfers of funds to the Card, or any other account you maintain at your designated financial institution.
B. You agree to immediately forward payment to us for all overdrafts, including any service charges. You also agree to pay overdraft charges in effect from time to time for each transaction, which causes your available account balance to overdraw the funds available on the Card. If the balance on the Card account remains at a negative balance, you agree that we may initiate a transfer from any Funding Account for the amount of such negative balance. At any time, we may transfer funds from an account you maintain at your designated financial institution for the amount of such negative balance.

The foregoing fees may be changed upon thirty (30) days prior written notice to you.
*The owner of an ATM may charge an additional access fee.
V. Verification of Transactions
A. You and the Teen are entitled to receive a transaction record or receipt each time a transaction is completed using the Card at an electronic terminal or ATM. In addition, all Card transactions will be listed separately on the online Card account statement.
B. You and the Teen will receive a monthly statement of the Card account for each monthly cycle. You agree that we may provide your monthly statement and any other notices hereunder electronically. We will notify you by electronic mail message, sent to the electronic mail address which you provided for such notices upon account setup, monthly that the monthly statement for the Card account is available for viewing online at the website listed below. Statements provided electronically will describe each transaction made using the Card during the statement period. Your statement will be available to you in electronic format for viewing. You may print your statement for your record keeping or future reference. You may review the past twelve months worth of transactions online at any time. In the event that you elect to revoke consent to receive statements electronically a fee will apply (see Section IV.12) and we reserve the right to terminate the Card account.
C. You may review the last ten (10) Card transactions through our telephone customer service number 866-763-3372 or at some ATMs. Service fees may apply; refer to Section IV above.
VI. Failure to Complete Transactions
A. We accept no liability to complete any transaction for which adequate funds have not been supplied by you according to the rules of the Card.
B. Likewise, we accept no responsibility for funding delays that are the result of late receipt of funding payments by you to the Card account.
C. We are not responsible if you or the Teen do not have enough money in the Card account to complete a particular transaction. You or the Teen may, however, split the purchases between the Card and another credit or debit card or cash. If you or the Teen are uncertain as to your exact balance available on the Card, please review your Card account online, or call the Visa Buxx Card customer service, number listed in Section V above, to verify the Card’s available balance prior to attempting to make a purchase.
D. Neither we nor any other bank or business will be liable to you or the Teen for failure to accept or honor the Card.
VII. Disputes/Returns and Refunds
A. You and the Teen agree to settle all disputes about purchases made using the Card with the merchant who honored the Card.
B. If you or the Teen is entitled to a refund for any reason for goods or services obtained with the Card, you and the Teen agree to accept credits to your Card account by the merchant in place of cash.
VIII. International Transactions
A. Foreign Currency Exchange Rates - If you or the Teen use the card for an international transaction in foreign currency, Visa International will convert the transaction amount from the foreign currency amount to a United States Dollar amount, in accordance with its currency conversion procedures set forth in its Operating Regulations in effect at the time the transaction is processed. Currently those regulations provide that the currency exchange rate is either (1) a rate selected by Visa from the range of rates available in wholesale currency markets for the applicable central processing dates, which rate may vary from the rate Visa itself receives, or (2) a government-mandated rate in effect for the applicable central processing date, plus a Currency Conversion Fee as discussed below. The currency exchange rate in effect on the processing date may differ from the rate in effect on the transaction date or on the posting date.
B. Currency Conversion Fee - A Currency Conversion fee is charged for each international transaction (i.e., a transaction occurring in any country outside the United States, Puerto Rico or the U.S. Virgin Islands), if foreign currency is converted. The current Currency Conversion fee is 2% of the transaction amount and will be displayed as a separate transaction on your monthly statement
IX. Loss, Theft or Unauthorized Use
A. You are responsible for all authorized uses of your Card. Applicable law and our "zero liability" policy (both of which are more fully described herein) may protect you from liability for unauthorized purchases. You understand that your Card is not a credit card and is not protected by laws covering credit cards such as the federal Truth in Lending Act.
B. Tell us AT ONCE if you or the Teen believes the Card or PIN has been lost or stolen. Telephoning is the best way of MINIMIZING YOUR POSSIBLE LOSSES. IF YOU OR THE TEEN BELIEVE THAT YOUR CARD OR PIN HAS BEEN STOLEN, OR THAT SOMEONE HAS ACCESSED OR MAY ACCESS MONEY FROM YOUR CARD WITHOUT YOUR PERMISSION, CALL US AT 866-763-3372. IF YOU OR THE TEEN FAIL TO NOTIFY US PROMPTLY AND YOU ARE GROSSLY NEGLIGENT OR FRAUDULENT IN THE HANDLING OF YOUR CARD, YOU COULD LOSE ALL THE MONEY IN THE CARD ACCOUNT.
C. Also, if your statement shows transactions that neither you nor the Teen made, tell us at once. If you do not tell us within 60 days after the statement was made available to you online, you may not get back the money you lost after the 60 days, if we can prove that we could have stopped someone from taking the money if you had told us in time. If you were grossly negligent or committed fraud in handling the Card, the amount of money you could lose for unauthorized purchases could increase to the maximum allowed by law.
D. If your Card has been reported to us as lost or stolen, we will close your account to keep losses down.
X. The following Notice Contains Information about Your Right to Dispute Errors
A. In case of errors or questions about electronic transactions on the Card, call 866-763-3372 or write us at Visa Debit Processing Service, P.O. Box 262117, Highlands Ranch, CO 80163-2117 as soon as you or the Teen can, if you or the Teen think the Card statement or receipt is wrong or if you or the Teen need more information about a transaction listed on the statement or receipt. We must hear from you no later than 60 days after the transaction in question has been made available to you on the online statement.
B. The following information must be contained in that notice:
1. Your and the Teen’s name and Card account number
2. Describe the error or the transaction you or the Teen are unsure about and explain as clearly as you can why you believe it is an error or why you need more information.
3. The dollar amount of the suspected error.
C. If you or the Teen tell us orally, we require that you also send us your complaint or question in writing within 10 business days.
D. Generally, we will tell you the results of our investigation within ten (10) business days after we hear from you or the Teen and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) calendar days to investigate your complaint or question. If we decide to do this, we will re-credit your Card account within ten (10) business days for the amount you think is in error so that you and the Teen will have use of the money during the time it takes us to complete our investigation. Because we ask you to put your complaint or question in writing, if we do not receive written confirmation of your oral notice within 10 business days, we will not re-credit the Card account. If notice of an error involves an electronic fund transfer that was initiated other than in any state, territory or possession of the United States, the District of Columbia, the Commonwealth of Puerto Rico or any political subdivision of any of the above; or involves an electronic fund transfer resulting from a POS debit card transaction, the applicable time periods for action shall be ninety (90) calendar days in place of the forty five (45) calendar days.
E. If we decide there was no error, we will send you a written explanation within three (3) business days after we finish our investigation. You may ask for copies of documents that we used in our investigation. At that point, your card will be debited by the amount of the credit given plus any applicable fees.

XIII. Waiver Release from Third Parties
A. Unless the law provides otherwise, you and the Teen waive and release us from any obligations that could arise due to defenses, rights and claims you or the Teen have or may have against any third party on account of the use of the Card.
XIV. No Right to Stop Payment
A. You understand and agree that neither you nor the Teen is permitted to stop payment on any purchase through the use of the Card.
XV. Amendment/Cancellation
A. We may at any time amend these terms and conditions. You will be notified of any change in the manner provided by applicable law prior to the effective date of the change. You specifically agree to accept such notice of change by notice sent to the last electronic mail address you have provided to us. However, changes made for security purposes, can be implemented without prior notice. You can review the current Agreement on our website at www.InnovativeCardServices.com click on Buxx login. If you notify us that either the Change in Terms and Conditions is not acceptable or that you no longer agree to accept to receive notices of Change in Terms and Conditions electronically, we may cancel or suspend this Agreement or any features or services of the Card at any time. If you or the Teen continue to use the card, you will be bound by the change in the Terms and Conditions.

B. We may cancel your right or the right of the Teen to use the Card at any time. However, your obligation under this Agreement and any charges made under it prior to cancellation will remain your responsibility. Any Card which we supply to you is our property and must be returned to us immediately upon demand or upon notice of cancellation or withdrawal of your Card. Any monies remaining on the Card account will be returned to you.
C. You may cancel this Agreement by returning the Card to us at the address above or calling telephone customer service at 866-763-3372 and closing your account. Any termination of this Agreement will not affect any of our rights or your obligations arising under this Agreement prior to termination. Upon receipt of your notice, the Card will be cancelled and any monies remaining on the Card account will be returned to you. Service fees may apply; refer to section IV.
XVI. Zero Liability
A. With our Zero Liability policy, your liability for unauthorized transactions is $0. You will not be liable for any unauthorized purchases made through the Visa network of merchants, including those transacted on the Internet if you contact us within sixty (60) days after the monthly account statement on which the transactions occurred was made available to you. This policy does not apply to ATM cash withdrawals or other ATM transactions. You agree to assist us in determining the facts, circumstances and other pertinent information relating to any loss, theft or possible unauthorized use of your Card and to comply with such procedures as we may require in connection with our investigation. If you authorize someone to use your Card, you are responsible for all transactions they initiate using your Card until you notify us that such transfers are no longer authorized.
XVII. Governing Law
A. This Agreement and its performance shall be governed by the laws of the state of Indiana, United States of America, without regard to its conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Elkhart County, the state of Indiana, United States of America, in all questions and controversies arising out of your use of this Site and this Agreement. Some states may not permit such consent, so the foregoing may not apply to you.
XVIII. Other Terms
A. The Card and your obligations under this Agreement may not be assigned except to an authorized user who is an approved enrollee in the program. We may transfer our rights under this Agreement.
B. Use of the Card is subject to all applicable rules and customs of any clearinghouse or other association involved in transactions.
C. We do not give up our rights by delaying or failing to exercise them at anytime.
D. If any term of this Agreement is found by a court to be illegal or not enforceable, all other terms will still be in effect.
E. If we take legal action against you because of default in the terms of this Agreement, or if we are required to defend ourselves in any legal, equitable or regulatory matter, you must pay reasonable attorney's fees and other costs of us and the proceedings. Your responsibility for fees and costs shall in no event exceed the maximum allowed by law.
NOTICE OF ATM/NIGHT DEPOSIT FACILITY USER PRECAUTIONS
As with all financial transactions, please exercise discretion when using an automated teller machine (ATM) or night deposit facility. For your own safety, be careful. The following suggestions may be helpful.
1. Prepare for your transactions at home/hotel (by noting your planned withdrawal in your records) to minimize your time at the ATM or night deposit facility.
2. Mark each transaction in your account record, but not while at the ATM or night deposit facility. Always save your ATM receipts. Don’t leave them at the ATM or night deposit facility because they may contain important account information.
3. Compare your records with the account histories that you look up on the website.
4. Don’t lend your Buxx Card, Gift Card or ATM card to anyone.
5. Remember, do not leave your Buxx Card, or Gift Card at the ATM. Do not leave any documents at a night deposit facility.
Protect the secrecy of your Personal Identification Number (PIN). Protect your card. Don’t tell anyone your PIN. Don’t give anyone information regarding your Card or PIN over the telephone. Never enter your PIN in any ATM that does not look genuine, has been modified, has a suspicious device attached, or is operating in a suspicious manner. Don’t write your PIN where it can be discovered. For example, don’t keep a note of your PIN in your wallet or purse.
